Lori Molnar Joins Icard Merrill as Real Estate Closer

Ms. Molnar joined the firm in August as a real estate closer and will work closely with Steven R. Greenberg, Esq. and Natalie A. Greenberg, Esq.  in the real estate law division. She has more than 11 years of experience in the title insurance industry and is a licensed Florida title agent. Ms. Molnar has worked as a real estate closer and marketing representative in previous positions with both attorneys and title companies in the greater Sarasota area.

He officially joined the firm on August 18th and concentrates his practice in the areas of land use and zoning, construction, governmental liability, commercial and general civil litigation, and appeals.

Mr. Ellis graduated cum laude in 2007 from University of Florida Levin College of Law and summa cum laude in 2003 from Florida State University with a Bachelor of Science degree in Political Science and Criminology. He comes to the West Coast having served for nearly seven years as an associate attorney for a West Palm Beach law firm, where he practiced in various areas of commercial litigation, construction defects, governmental liability, premises liability, products liability, and appeals. Mr. Ellis is an Eagle Scout (1993) with the Boy Scouts of America and continues to volunteer with the BSA on a local, state, and national level. Matt Brockway Named Shareholder at Icard Merrill

A member of the firm since 2008, Mr. Brockway practices primarily in the areas of land use, zoning, real estate, and intellectual property law. He represents developers and land owners in all phases of complex real estate transactions and land development projects, including commercial, residential, and mixed-use projects. He also represents corporate and individual clients in a diverse array of intellectual property matters, including patents, trademarks, copyrights, licensing, litigation, and asset management.

Originally from Palm City, Florida, Mr. Brockway is a graduate of the University of Florida where he earned a B.S. in Civil Engineering, a M.S. in Engineering (Engineering Construction Management), and his Juris Doctor with certificates in environmental and land use law and intellectual property law. Before joining Icard Merrill, he served as an intern at the World Intellectual Property Organization, a specialized agency of the United Nations, where he analyzed and formulated key policy positions with respect to emerging international intellectual property issues.

Mr. Brockway is currently a member of the Florida Bar and the Sarasota County Bar Association and is admitted to practice in the State Courts of Florida, the U.S. District Court for the Middle District of Florida, the U.S. Court of Appeals for the 11th Circuit and the Federal Circuit, and the United States Patent and Trademark Office. 12th Judicial Circuit Court Partners with Icard Merrill to Launch Family Law Guardian ad Litem Pilot Program

(Southwest Florida) – The 12th Judicial Circuit Court of Florida has launched a pilot program designed to provide guardians ad litem for children involved in high-conflict divorce and custody cases in the Circuit's Family Law Division. All the volunteers for this ground-breaking program are attorneys from the Sarasota and Manatee County offices of the law firm of Icard, Merrill, Cullis, Timm, Furen & Ginsburg, P.A.

The program is directed by the Honorable Lee E. Haworth and Charles E. Williams, who are co-chairs of the Circuit's pro bono program. After recognizing a need for independent parties to represent the best interests of children in contentious cases, the judges approached Robert Lyons, president of Icard Merrill, to ask if the firm would consider volunteering to advocate for these children, all of whom are from families at or below the poverty line. Icard Merrill has a substantial history of providing pro bono services to the local community, and it was this dedication that prompted Icard Merrill to respond positively to the challenge.  Twenty-four Icard Merrill attorneys have signed up to volunteer, from new associates to the most senior shareholders, drawing from all of the firm's practice groups and specialties.

"Children caught in the middle of an acrimonious divorce need an independent voice to speak for them in court, to make unbiased recommendations and to ensure the judges have the best information possible," said Judge Haworth. "Because there is no state-funded program to allow guardians ad litem in family court, we have created this pro bono program to address a very real need in our circuit. I commend Icard Merrill for being willing to take this on as I know it will be a significant investment of time and resources. The end product, however, will be a better result for children, and there can be no higher calling than the protection of vulnerable kids."

The attorneys, joined by judges, judicial staff and various family court personnel, have already completed their training for the program, and case assignments are expected to begin in May in the Sarasota and Venice family divisions. If the program is as successful as expected, it may be opened in the future to other attorneys, regardless of specialty, who wish to volunteer to help children in this unique way.

Guardian ad Litem pilot program – 12th Judicial Circuit Court

Questions & Answers

Q: What prompted this program?
A: It is crucial that children involved in legal proceedings have an advocate who will look out for their interests. While a Guardian ad Litem program (GAL) exists in dependency court for children who have been neglected or abused by their parents, no such program is available for children in the Family Division who are impacted by contentious custody cases.  Children who are caught in the crossfire of a bitter divorce may suffer long-term trauma. Judges have recognized the importance of having better information about these children and their needs through an independent voice who will speak for them in court.

Q: Who will the program serve? How will it work?
A: The pilot program will focus exclusively on high-conflict divorce and child custody cases involving families who are at or below the poverty line. The pilot program will begin in Sarasota County, with the three Family Division judges in Sarasota and Venice will appoint private GALs for a limited number of cases.  These are the Honorable Debra Johnes Riva, the Honorable Rochelle Curley, and the Honorable Robert W. McDonald, Jr.

The pilot program will be directed by the Honorable Charles E. Williams and the Honorable Lee E. Haworth, both acting in their capacity as co-chairs of the 12th Judicial Circuit Pro Bono Committee.  The judges invited the attorneys of Icard Merrill to volunteer as the guardians ad litem.

Stacy Dillard-Spahn will serve as Icard Merrill's point of contact and will assist in identifying volunteer attorneys based on availability, scheduling and any special circumstances. Two of Icard Merrill's most highly experienced family law attorneys – Jaime Wallace and Art Ginsburg – will serve as mentors and advisors to their fellow attorneys as needed.

Q: Why was Icard Merrill selected for this program?
A: Judges Williams and Haworth recognized Icard Merrill's strong tradition of pro bono service and asked the firm to help establish the program. This represents a major commitment of the firm's time and resources and is tangible proof of Icard Merrill's ongoing dedication to public service.

Q: What are the responsibilities of the attorneys involved?
A: Volunteer GAL attorneys will have broad powers to investigate and report as authorized in §61.403, Florida Statutes. Attorneys will make recommendations as to the best interests of the children involved and provide information to aid the judges in making decisions on custody issues and determining whether the educational, social and medical needs of the children are being met.

Q: Does this program exist elsewhere?
A: Yes, a similar successful program has been in effect in Pinellas County since 2011.

Q: When will the program begin, and what preparations have been made?
A: Appointments will begin in May in Sarasota. A training session was conducted in April for Icard Merrill lawyers, judges and their judicial assistants. The training was at Icard Merrill's Sarasota office and was conducted by 6th Circuit Judge Jack Helinger and family law attorney Belinda Lazzara, both of St. Petersburg, as well as Judge Haworth, Jaime Wallace, Sarasota psychologist Brad Broeder, and staff from the local family court programs.

Q: Who are the attorneys involved in this program?
A: The following Icard Merrill attorneys have agreed to serve as GAL advocates. It should be noted that few of the volunteers are family lawyers, nor do they have to be to provide service.  Most of the attorneys practice in unrelated fields, but share a common concern to help vulnerable children.

Foreman, an attorney and shareholder at the law firm of Icard, Merrill, Cullis, Timm, Furen & Ginsburg, P.A., was featured as a presenter at the 2014 Bench Bar Conference, held recently at Hyatt Sarasota. This annual event is sponsored by the Manatee and Sarasota county bar associations and is open to members of the 12th Judicial Circuit. The theme of this year's conference focused on current issues related to civility and professionalism within the legal industry. 

Mr. Foreman served as a panelist in a breakout session dedicated to civility for transactional lawyers. Topics included recognizing the value of candor and transparency, strategies for dealing with unrepresented parties, and frequent areas of professional and ethical violations that are unique to attorneys practicing business, real estate, probate, estate planning and guardianship law.

As a shareholder at Icard Merrill since 1969, Mr. Foreman has focused his practice on estate and trust planning and administration, guardianships and real estate. Sarasota Orchestra Reception Honors New Music Director and Estonian Ambassador

A reception was held recently to honor Anu Tali, the new Music Director of the Sarasota Orchestra, and Estonian Ambassador Marina Kaljurand in conjunction with the opening night concert of the Sarasota Orchestra on February 21st. Ms. Tali is a native of Estonia and is currently directing her first season with the orchestra. The Ambassador was in town for the official opening of the Honorary Consulate of the Republic of Estonia in St. Petersburg and was the speaker at the Estonian Society of Central Florida's annual independence luncheon in Clearwater. Also attending the reception was Icard Merrill employee Monika Craig, who is an Estonian American National Council (EANC) member and a member of the Estonian Society of Central Florida.

Ms. Tonitis joined the firm in January as a closing processor in the real estate law division. She is a lifelong resident of Sarasota with more than 12 years of experience in multiple facets of the real estate industry. She began her career as a closing processor for Chelsea Title and has also worked as a Realtor and a licensed mortgage broker.

"We are delighted to have Kristie with us," said Mr. Greenberg. "Her varied experience in the real estate industry will enable us to further enhance the closing and escrow services we offer our clients."

Icard Merrill Attorney Robert K. Lincoln Will Speak at Land Use Seminar in Orlando

Robert K. Lincoln, a member of the Sarasota law firm, Icard, Merrill, Cullis, Timm, Furen & Ginsburg, P.A., will speak at an upcoming land use seminar sponsored by The Florida Bar City, County and Local Government Law Section. The seminar will be held Thursday, May 8th at the Lowes Royal Pacific Resort in Orlando. Mr. Lincoln, who frequently lectures about land use, zoning and other government issues, will discuss recent court decisions and their possible influence on land use and development in Florida.

Mr. Lincoln has been a member of Icard Merrill since 2004.  He represents public and private clients in all aspects of the land development process, with a focus on complex land use, zoning approvals and litigation.  With an extensive academic and professional background in planning, zoning and growth management, he has written, published and lectured extensively on land use topics.  Mr. Lincoln has been a resident of Sarasota since 1977 and was recently appointed to the New College Foundation Board of Directors.

Icard Merrill Welcomes the Addition of Two New Associate Attorneys

The law firm of Icard, Merrill, Cullis, Timm, Furen & Ginsburg, P.A. is pleased to announce the addition of two new associate attorneys – Robert Young and Jordan J. Riccardi. "We are fortunate to have these two fine attorneys join our firm," said President Robert G. Lyons. "They represent our continuing expansion in family law and business law, and we are confident that they will be valuable additions both to our offices and to the communities they serve."

Jordan Riccardi was named an associate attorney at Icard Merrill after serving as a law clerk to firm member Todd Kaplan for the previous year. Based in the Lakewood Ranch office, Mr. Riccardi has concentrated his practice on estate planning, estate and trust administration, business law, and BP-Oil Deepwater Horizon economic settlements. He earned his Juris Doctor from Ave Maria School of Law in Naples and a Bachelor of Arts degree in History from St. Leo University. His previous experience includes internships with the corporate counsel for Chico's Inc. and the Tampa Division of the U.S. Federal District Court.

Robert Young joined Icard Merrill in February. He has focused his practice in family law and will be located in the downtown Sarasota office. Prior to joining the firm, he worked as a law clerk and pro bono attorney for Legal Aid of Manasota. Mr. Young received his Juris Doctor from the University of Illinois College of Law, where he graduated cum laude with a pro bono notation for public service. He earned his Bachelors of Arts degree in History and Political Science from the University of Miami and is a former law clerk for the office of the Illinois Attorney General.
